Over the past 3 days we have had more of our Constitutional rights violated then ever before in our lives together, and the sad fact is we allowed it to happen because we did not know what our rights were. I am posting this to inform any and everyone of their rights if, heaven forbid, they find themselves in the nightmare we have found ourselves in over the past 3 days.On Saturday night while I was bathing my 17 month old baby girl, I noticed a strange discoloration, a yellowy green color, just between her rib cage, in the space below her sternum, and the same discoloration around the base of her neck. It appeared to be old bruises, but there had been no marks there the day before. I called the ER to be advised. They told me that it was necessary to bring her in because when those color of marks just appear that could be a sign of a serious blood issue and if my daughter were to be cut at that point she could quickly bleed out. Of course I rushed her right in. As soon as she was seen by the ER doc. I started getting grilled. Here is the basic conversation. . .
Doc-"Well we will need to do a chest x-ray to determine if she has rib fractures at various stages of healing, that will determine if there has been any child abuse."
Me-"If there were rib fractures wouldn't she be in pain? I hold her around the ribs to pick her up, to wash her hands, to carry her around, she has never acted like this was painful. Also wouldn't the discoloration be on her ribs if there were fractures present?"
Doc-"Well you bring your child in here with bruises all over her, what do you expect me to do? Why did you even bring her in here tonight?"
Me-"I was told there could be a serious blood issue, that when coloration of this kind just appears it could mean a potential serious problem."
Doc-"Well who knows why those marks are there! We can do blood tests if you want to."
Me-"Well if there is nothing that is serious to her tonight and it can wait for her pediatrician on Monday then I will just do that, I would rather not pay ER fees and put my daughter through something that there is really reason to assume there is a problem."
The Doc wrote up my discharge instructions that I was to follow up with the babies doctor on Monday and I was allowed to leave. By this time it was about 11pm. Way past the babies bed time. I took her home and put her right in bed.
About a half our later there was a knock at our door. I opened it to find a Child Welfare lady and an armed police officer.
Our First Mistake #1 We let them come in our home. Even the scary CPS people can not come into your house without and order from a judge your 4th amendment right is a right to privacy in your home.
We let them in, they made me wake up my baby, strip her naked so they could take pictures of her. #2 We allowed this to happen without a warrant, they will lie and manipulate and bully you into thinking you have to comply, you do not! they are investigators only they have no legal rights to see or take or do anything without a court order. If they bring an order only allow them to do exactly what the judge has allowed. If the order is to see the child do not allow them to do so in your home, if the order is to see your home, take your children out first.
Mistake #3 Of course I was petrified that these people were in my house, I thought they could take my kids right then if they wanted to (they can not), I started talking, and talking and talking. . . Do not tell them anything. If they need to find some dirt on you, let them find it, do not provide them with anything. Amendment 5 and Miranda.
Mistake #4 They showed back up Monday afternoon and I let them back in(as you can tell our research was late in coming) They informed me I had an appointment in 15 minutes at the Child Advocacy Center for a full physical exam to be done on the baby.
Mistake #5 I did not tell them NO, I would be happy to take her in to her regular doctor if you get a court order that an exam is necessary.
#6 I allowed them to dictate when and were I was going to be, Down at the doctor right during the babies nap and right during the time I needed to be home to get my kids off the bus.
#7 I allowed a physical exam to take place, one in which the baby was striped down naked again and they spent more time VIDEO TAPING her privates then anything else.
#8 they ordered a full work up at the hospital, blood work and a full skeletal x-ray even though there were absolutely no marks on the baby at this point, even the discolorations were completely gone.
#9 We took her over to the hospital were she was strapped to a table her hands taped down and she was mummied in a blanket, while she screamed like we have never heard her do before for a full 25 minutes while they took 20 pictures of ALL of her tiny little bones that have never been damaged in her life. She has experienced more abuse in the name of "her best interest" at their hands then any other time in her short 17 months.
We were also informed that they would be interviewing our other children. We know our rights now and you can bet this will not be happening, unless they present a court order. If they do so, they will try to tell you, you can not be present, you absolutely can and should and should also video the entire thing. But remember do the interviews else were. They will go to the school with out your knowledge and try to interrogate your kids. You have to submit a letter to the school that your children are not allowed out of class to see anyone but yourself, they will try to get them while they are at school and you are unaware what is going on. These people have a quota to meet. They do not get paid unless they find children to save. they will do whatever it takes to find and create whatever they can for their job security. And your American children have the same rights you do, if they are called on to be interviewed, with a court order, they must attend the interview but they have the right to remain silent.
I pray none of you ever find yourselves in a situation like this, you can bet I never thought we would be here. I have never even spanked my kids and now I have an allegation just because I rejected an arrogate doctors orders and refused to have tests done that were unjustified and I couldn't afford. i have never felt so bullied and victimized as I have over the past few days and the thing that is the most maddening, is that it ALL could have been avoided if only I had been more educated!
You can bet I will be taking the next "Know your Constitution"class as soon as I find one!
The only thing you need to do for the Child Services people is be very polite, because they can get you for contempt of a social worker.
